Terms of Service

These Terms of Service (“Terms”) govern your access to and use of buildclearance.com (the “Site”) and the zoning and permit intelligence reports and related services (collectively, the “Service”) provided by BuildClearance, a service of Triad Core Builders (“we,” “us,” or “BuildClearance”). By placing an order, creating an account, or using the Site, you (“Customer” or “you”) agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

BuildClearance is operated by Triad Core Builders, a North Carolina business. Reports are validated by Narayanan Bakthisaran, founder of Triad Core Builders (NC GC License #L.99646). Contact: /contact or hello@buildclearance.com.

2. Description of Service

BuildClearance produces written intelligence reports analyzing zoning, dimensional compliance, overlay districts, flood-zone status, permitted uses, permit requirements, and a proprietary BuildClearance Screening Score for North Carolina real estate parcels. Standard delivery is a 13-page PDF within 48 hours of order. Rush delivery (12 hours) and Report + Consult options are available at the prices listed at the time of order.

3. NOT Legal or Engineering Advice

Reports are for informational and planning purposes only. A BuildClearance Report is not a legal opinion, not a zoning verification letter from a municipal authority, not an engineering certification, not a survey, and not a substitute for review by a licensed attorney, surveyor, or engineer. You agree that:

  • You will not rely on a Report as the sole basis for closing a real estate transaction, applying for a building permit, or executing construction.
  • You will obtain independent professional advice (attorney, surveyor, engineer, licensed contractor in the relevant jurisdiction) before any binding decision.
  • Where a municipal zoning letter, formal zoning determination, or land-use opinion is required by law, contract, or lender, you will obtain one directly from the jurisdiction or a licensed attorney — not from BuildClearance.

4. Data Sources and Accuracy

Reports rely on data from public-record sources including (but not limited to) county GIS systems, municipal zoning ordinances, the FEMA National Flood Hazard Layer, parcel-data providers, and jurisdiction permit-process documentation. We make a reasonable effort to verify the data at the time of report generation. We do not guarantee that:

  • Public-record data is current, complete, or free of error.
  • A municipality will not subsequently rezone, amend an ordinance, or change a permit process.
  • Site-specific conditions discoverable only by physical inspection, survey, title search, or recorded-instrument review are reflected.

5. Materially-Inaccurate Refund Policy

If a delivered Report contains a material factual error — meaning a stated fact about zoning classification, district setback/dimensional standards, current flood-zone designation, or permit office that is demonstrably incorrect at the time the Report was generated — we will, at our discretion, either:

  1. Issue a corrected Report at no charge, OR
  2. Issue a full refund of the Report price.

To request review, email hello@buildclearance.com within 30 days of Report delivery with the specific factual error and supporting documentation (e.g., the municipal source document showing the correct value). We do not refund based on subjective disagreement with the Screening Score, the GC’s judgment, or a Report whose factual content is correct but whose conclusion is not what the Customer hoped to hear.

Rush surcharges and Consultation fees are non-refundable once the rush window has elapsed or the consultation has been delivered, regardless of Report outcome.

6. Payment, Pricing, and Delivery

Payment is processed by Stripe at the time of order. Prices are listed in U.S. dollars and exclude any applicable sales tax. By submitting payment you authorize the charge and confirm that the payment method is yours.

The 48-hour standard turnaround and 12-hour rush turnaround are measured from receipt of cleared payment and a complete property address. Delays caused by incomplete address information, county GIS outages, or other circumstances beyond our reasonable control extend the turnaround proportionally. We will notify you by email if a delay exceeds the stated window.

7. License to Use the Report

Upon delivery, BuildClearance grants you a non-exclusive, non-transferable license to use the Report for your own evaluation of the subject property. You may share the Report with your direct advisors (attorney, lender, agent, contractor) involved in the same transaction. You may NOT:

  • Resell, republish, or redistribute the Report for compensation.
  • Strip the BuildClearance branding, GC validation, or footer attribution.
  • Use the Report as marketing material implying BuildClearance endorses a particular transaction outcome.

Agents enrolled in the BuildClearance Referral Program may share a Report with the property owner or buyer who is their direct client; this is expected and permitted.

8. Customer Conduct

You agree not to use the Service for any unlawful purpose, not to submit knowingly false property addresses, and not to attempt to circumvent payment, automate ordering without authorization, or interfere with the operation of the Site. We may suspend or terminate Service for repeated violations.

9. Disclaimers and Limitation of Liability

THE SERVICE AND REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDCLEARANCE AND TRIAD CORE BUILDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR ANY REPORT IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DEALS, OR PROPERTY-VALUE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY.

10. Indemnification

You agree to indemnify and hold harmless BuildClearance, Triad Core Builders, Narayanan Bakthisaran, and our agents from any claim, demand, loss, or damage (including reasonable attorney’s fees) arising from (a) your breach of these Terms, (b) your use or sharing of a Report in a manner inconsistent with Section 7, or (c) your reliance on a Report in lieu of obtaining the independent professional advice required by Section 3.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Guilford County, North Carolina, and you consent to personal jurisdiction and venue there. You and BuildClearance each waive any right to a jury trial.

12. Privacy

Our handling of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted by updating the “Last updated” date and, where appropriate, sent to active customers by email. Continued use of the Service after a change constitutes acceptance.
